Welcome to Fab Concept. These Terms & Conditions (“Terms”) govern all business conducted with Fab Concept (“we”, “our”, “us”) by trade clients, retailers, interior designers, hospitality businesses, or any other professional buyer (“you”, “your”). By placing an order or using our services, you agree to these Terms.
1. Business Use Only
Fab Concept operates strictly on a business-to-business (B2B) basis.
By engaging with us, you confirm that you are acting on behalf of a business and not as a consumer. Consumer rights legislation does not apply.
2. Orders & Pricing
All orders are subject to acceptance by us in writing (including email).
Prices quoted exclude VAT unless otherwise stated.
We reserve the right to amend prices prior to order confirmation in case of material changes in costs (including raw materials, transport, or supplier pricing).
While we take care to ensure accuracy, errors or omissions in pricing, product descriptions, or other information on our website, catalogues, or other materials may occasionally occur. We reserve the right to correct such errors and are under no obligation to supply goods at an incorrect price, even after an order has been placed. If an error affects your order, we will notify you and give you the option to reconfirm at the correct price or cancel.
3. Payment Terms
Payment terms are strictly Pro Forma.
Goods will not be released until cleared payment is received in full.
This may impact stated lead times if payment is delayed.
Ownership of goods remains with Fab Concept until full payment is received.
4. Delivery
Delivery is arranged through our trusted third-party courier partners.
While we aim to assist, we cannot accept responsibility for any damage caused in transit.
We will liaise with the courier on your behalf and revert back to you with the outcome.
If a customer delivery has been booked and is cancelled or refused, a failed delivery charge equal to the delivery cost will apply.
Risk in the goods passes to you once delivery has taken place.
Delivery Delays: If delivery is late or delayed, we cannot reimburse costs or cancel the order due to the delay. We will rebook delivery with our courier and notify you of the new schedule.
Assembly / Room-of-Choice Service:
The fitting service includes taking the bed to a room of your choice and assembling it.
This service does not include dismantling any existing beds. We ask the room is ready for the set up.
Customers must ensure that stairways, doors, and access points are measured correctly. If the bed or mattress cannot pass through, the driver will not accept a return, and we will not be liable.
5. Cancellations & Returns
Change of Mind: As we operate strictly on a B2B basis, we do not accept returns or cancellations for change of mind once an order has been confirmed.
Bespoke or Custom Orders: Orders for bespoke or customised products cannot be cancelled, amended, or returned once production has commenced, except in cases of manufacturing defect.
Standard Products with Modifications: If a standard product is customised in any way, it is deemed a custom-made order and is not eligible for return or refund.
Mattresses: For hygiene and health & safety reasons, mattresses cannot be returned if the original packaging has been opened.
Faulty or Damaged Goods on Delivery:
You must inspect all goods upon delivery and notify us in writing within 5 working days of any defects, shortages, or damage.
Photographic evidence must be provided by email to hello@fabconcept.co.uk within the same timeframe.
Where a defect is accepted, we will (at our discretion) repair, replace, or issue a credit note for the affected goods.
Goods must be unused and stored appropriately until inspection.
Returns Procedure: No goods may be returned without prior written authorisation from Fab Concept. We will provide return instructions where applicable.
Liability: Our liability for defective or damaged goods is limited to the remedies set out above. We do not accept responsibility for consequential losses, missed deadlines, or costs incurred by third parties.
6. Warranty
1-Year Comprehensive Warranty: All Fab Concept bed frames are supplied with a 1-year comprehensive warranty covering defects in materials and workmanship. During this period, we will (at our discretion) repair or replace the full product or any defective part at no cost, including labour and transport.
4-Year Parts Warranty: Following the initial 1-year period, we provide a further 4-year parts warranty. If any component of the bed frame fails due to a manufacturing defect, we will provide replacement parts free of charge. Labour, transport, or third-party costs are not included after the first year.
Exclusions: This warranty does not cover:
Normal wear and tear.
Damage caused by misuse, improper assembly, or failure to follow care instructions.
Modifications or repairs carried out by anyone other than Fab Concept or an approved service partner.
Fabric, upholstery, or finishes, which may naturally vary over time.
Conditions:
The warranty is valid from the date of delivery to the original purchaser.
Claims must be made in writing with proof of purchase and supporting evidence.
Our liability under this warranty is limited to repair or replacement of defective products or parts; it does not extend to incidental or consequential damages.
Business-to-Business Note: This warranty is offered to trade buyers only and is non-transferable to end consumers unless explicitly agreed in writing.
7. Product Variations
All Fab Concept products such as the beds and mattresses, are handmade. As such, there may be natural variations in finish, texture, dimensions, or construction.
Minor manufacturing tolerances are normal and not considered defects.
8. Dropshipping Customers
If you are ordering Fab Concept products for the purpose of resale or dropshipping to your own customers, you acknowledge that you are our direct customer and not the end user.
You must communicate our warranty, delivery, and returns policies accurately to your end customers. Fab Concept is not liable to your end customers for any issues.
All orders placed by dropshipping customers are treated as B2B orders, and consumer protection legislation does not apply.
You are responsible for any discrepancies, complaints, or disputes with your end customers. Fab Concept’s liability remains limited to your business as the purchaser.
Any bespoke, custom, or modified products supplied for dropshipping are subject to the same terms regarding cancellations, returns, and warranty as standard B2B orders.
9. Intellectual Property
All designs, images, and product concepts remain the property of Fab Concept.
You may not copy, reproduce, or use our photographs, images, or other materials on any platform without prior written consent.
10. Website images and content
• Some images on the Fab Concept website may be supplied by our trade customers or may include customer installations.
• Fab Concept does not assume responsibility for these images and does not grant permission for third parties to use them.
• We recommend that customers or partners either:
• Use our own image creation service to generate unique product images, or
• Obtain permission from their own customers for any photos they wish to use.
11. Liability
Our liability is limited to the value of the goods supplied under the specific order.
We accept no responsibility for indirect, incidental, or consequential losses.
12. Confidentiality
All trade pricing, product specifications, and documentation shared with you are confidential and must not be disclosed to third parties.
13. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Updates
We reserve the right to amend these Terms at any time. Updated versions will be published on our website and apply from the date of posting.
